General Terms and Conditions

General Terms and Conditions
These General Terms and Conditions of Sale and Delivery (hereinafter referred to as GTC) of Sharkgroup AG (hereinafter referred to as the Seller) apply to all contracts between the Seller and the Buyer.

Prices
All prices are quoted in CHF and do not include VAT. The information in our online shop and in our price lists is non-binding.

Orders
In order to be able to offer you a fast service and to avoid misunderstandings, we ask you to order online or by e-mail if possible. By placing an order, you recognise the general terms and conditions.

 

Offer
The products shown online and in the catalogue are not binding. The product details do not constitute assurances, but are provided by way of example. We reserve the right to deviate from the ordered product due to improvements and model changes, even after order confirmation.

Delivery period and delay in delivery
Profloor:
Orders that reach us by 15:00 (Camion) and 16:30 (Post, Over Night Service) are usually delivered on the next working day.

Direct Handling / enia:
Orders that reach us by 4.30 p.m. are usually delivered the next working day.

If the Over Night Service is selected (up to max. 40 kg), delivery is usually made by 7.00 a.m. the following day.

The vendor accepts no liability for prior sale, delays in delivery by our suppliers, operational disruptions, processing and transport difficulties or force majeure.

Payment terms
10 days purely net. Unjustified discount, shipping or packaging deductions will not be recognised. Invoicing is done electronically. We would like to draw your attention to the fact that the statutory retention periods also apply to digital invoices and therefore ask you to archive these PDF files. CHF 5.00 will be charged for sending paper invoices.

Special
Larger objects and custom-made products possible on request.

For orders outside the standard range of Sharkgroup AG, the following payment conditions apply: 50% after receipt of the order confirmation, 50% after receipt of the goods. The complete delivery of the order takes place no later than 3 months after delivery of the goods to the Direct Handling AG warehouse.

In the case of custom-made products, we reserve the right to deliver 10% more or up to 5% less than the ordered quantity. The actual quantity delivered is calculated.

Default
After the payment deadline, a default interest of 5% will be charged and all discounts and special prices will be forfeited. Expenses and expenses for repeated reminders and necessary debt collection will be invoiced.

Ownership
Until all claims arising from the business relationship have been paid, the Seller retains ownership of its deliveries of goods.

Collection
Direct Handling / enia:
If the goods are picked up in 8856 Tuggen with a value of less than CHF 150.00, a flat rate of CHF 15.00 will be charged. For pick-ups on the same working day, a lead time of 1.5 hours is required.

 

Profloor:
Pick-up at the shop in 8610 Uster, at no additional cost.

Shipping cost share
Shipping is at the expense and risk of the customer.

The following shipping rates apply:

Package Service:
Parcels up to CHF 200.00: postage and packaging CHF 21.00
Parcels up to CHF 500.00: postage and packaging CHF 16.00
Packages from CHF 500.00: free delivery

Maximum mass:
up to 10 kg, length max. 250 cm
up to 30 kg, length max. 200 cm

Bulky goods surcharge: CHF 15.00
Express surcharge: CHF 25.00

The following parcels are considered bulky goods:
Shipments over 100 cm in length
Shipments with 2 dimensions over 60 cm

Camion Service:
For deliveries with a value of less than CHF 500.00, a flat rate of CHF 59.00 will be charged. From CHF 500.00 to CHF 999.95 CHF 39.00 and from 1'000.00 CHF 19.00.

Over Night Service:
Deliveries of goods up to 40 kg and max. 400 cm in length possible.
A flat rate of CHF 26.00 will be charged. Delivery usually takes place the following day by 7:00 a.m.

Dangerous goods surcharge: CHF 20.00
Telephone notification of deliveries: CHF 7.00
Scheduled delivery: CHF 80.00 / shipment
Repairs return transport: per pallet CHF 90.00

For orders under a value of CHF 500.00, a small quantity surcharge of CHF 19.50 will be charged. Excluded are pick-ups from the shop in 8610 Uster and parcel shipments.

Partial
Insofar as the acceptance of partial deliveries is reasonable for the customer, he must accept them.

Take-back of goods
A return for credit note is possible with a deduction of a processing fee of 20% of the net value, in the case of new stock goods including packaging. In any case, it is imperative to wait for a written confirmation from the seller. The return must be made postage-paid.

Complaint period for transport damage and other warranty claims
The buyer is obliged to inspect the goods immediately upon receipt of them and to report any transport damage immediately (in the case of ONS shipments by 10.00 a.m. the following day) and to have them confirmed directly in writing by the forwarder. Other warranty claims are forfeited if the buyer assembles or misplaces the goods without reservation. No liability is assumed for goods that are ready for collection by the customer outside the opening hours in front of our warehouse.

Warranty
The seller assumes the guarantee for the absence of defects and functionality of the product for 2 years after delivery or collection. The warranty only covers verifiable material or manufacturing defects. The Seller can optionally provide the warranty additionally by replacement delivery or repair.

The laying of floor coverings must be carried out in accordance with the appropriate installation instructions. The area of application must also be checked according to the installation instructions before installation. The installation instructions are included with each package or can be downloaded from www.enia-flooring.swiss. We are not liable for damage caused by improper installation.

Disposal fee
Electronic devices and machines do not belong in the household waste and must therefore be disposed of properly. This provision was enshrined in law in the Federal Ordinance on the Return and Disposal of Electronic Devices. We therefore charge you a flat rate for every machine purchased from us and thus ensure that it is disposed of properly when it is returned.

Compensation claims
The seller is not liable for simple negligence. Insofar as the liability of the Seller is excluded or limited, this also applies to the personal liability of all employees, employees, employees, representatives and vicarious agents of the Seller.

Application Notes
The instructions for use of the seller are to be understood as general guidelines. Due to the variety of uses of the individual product and taking into account the respective circumstances, the customer is responsible for his own testing, the correct selection of the product of the seller, the correct instruction of his own employees, the installation of any warning signs, and the monitoring of both the product and compliance with any safety regulations.

Final provisions
Changes to these GTC must be made in writing in order to be valid. Should individual provisions of these GTC or other contractual agreements be or become invalid in whole or in part, the remaining provisions and the validity of the contract shall remain unaffected.

Place of jurisdiction and applicable law
The exclusive place of jurisdiction for disputes arising from this contract is 8610 Uster. Swiss law is applicable.
